1. Acceptance & Eligibility

By accessing or using JustDMIt ("the Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must stop using the Platform immediately.

You must be at least 16 years of age to create an account. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian. We reserve the right to request proof of age at any time and to suspend accounts where eligibility cannot be verified.

2. Account Registration & Security

To use the Platform you must register an account with a valid email address and a secure password, or authenticate through a supported third-party provider (Google, GitHub, Discord).

• You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
• One account per person. Creating duplicate accounts to circumvent restrictions or bans is prohibited.
• You must notify us immediately at gm@justdmit.com if you suspect unauthorised access to your account.

3. Platform Description

JustDMIt is an AI-assisted tabletop role-playing game (TTRPG) platform. It uses artificial intelligence to generate narration, non-player characters, game mechanics, artwork, and other creative outputs for entertainment and creative purposes.

The Platform is not a substitute for professional legal, medical, psychological, or financial advice. AI-generated content may contain inaccuracies, fictional assertions, or creative embellishments. Users should not rely on any AI output as factual guidance.

4. Acceptable Use Policy

You agree to use the Platform only for lawful purposes. The following conduct is strictly prohibited:

4.1 Zero-Tolerance Violations (Immediate Permanent Ban)

• Child Sexual Abuse Material (CSAM) — any attempt to generate, upload, distribute, or solicit content that sexualises minors in any form, including textual, visual, or AI-generated. Violating accounts will be terminated immediately, all associated data preserved for law enforcement, and the incident reported to the relevant authorities including the National Centre for Missing & Exploited Children (NCMEC) and Polish law enforcement.
• Credible threats of violence — content that constitutes a genuine, actionable threat against any person or group.
• Terrorism or violent extremism — content that promotes, recruits for, or provides operational support to terrorist organisations.

4.2 Prohibited Conduct (Graduated Enforcement)

• Intellectual property infringement — uploading, reproducing, or distributing copyrighted material that you do not own or have the right to use. This includes verbatim reproduction of published rulebooks, novels, or artwork owned by third parties.
• Harassment & hate speech — using the Platform to harass, bully, threaten, or discriminate against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Illegal content generation — directing the AI to produce content that violates applicable law, including but not limited to defamation, fraud, or incitement to commit crimes.
• Reverse engineering — attempting to extract, decompile, or reverse-engineer the Platform's AI models, system prompts, or proprietary algorithms.
• Automated access — scraping, crawling, or using bots to access the Platform without prior written authorisation.
• Impersonation — misrepresenting your identity or affiliation, or impersonating JustDMIt staff.
• Service disruption — deliberately attempting to degrade, overload, or interfere with the Platform's infrastructure.

5. User-Generated Content & Intellectual Property

5.1 Your Content

You retain full ownership of all original creative content you create using the Platform, including but not limited to: characters, backstories, campaign narratives, world-building elements, plot outlines, and any other creative works you author.

By uploading or creating content on the Platform, you grant JustDMIt a non-exclusive, royalty-free, worldwide licence to host, store, display, process, and transmit your content solely for the purpose of operating and improving the Platform. This licence terminates when you delete the content or your account, except where retention is required by law or for legitimate security purposes.

5.2 AI-Generated Outputs

Content generated by the Platform's AI systems (narration, NPC dialogue, images, statblocks, maps, and other procedural outputs) is produced using machine learning models. JustDMIt grants you a non-exclusive, perpetual licence to use AI-generated outputs in your personal and commercial creative works, subject to any restrictions imposed by the underlying AI model providers.

Neither party claims exclusive ownership of AI-generated outputs. You are free to incorporate them into your stories, publications, or derivative works, but JustDMIt makes no warranty of originality or non-infringement for AI-generated content.

5.3 Platform Property

JustDMIt retains all rights in its technology, software, user interface, branding, logos, trademarks, AI model configurations, system prompts, and proprietary algorithms. Nothing in these Terms transfers ownership of any Platform intellectual property to you.

6. Third-Party Services & Dependencies

The Platform relies on third-party services to function, including but not limited to:

• AI model providers (OpenAI, Anthropic, Google, and others) — for content generation
• Cloud infrastructure providers — for hosting, storage, and compute
• Discord — for bot integration and community features
• OAuth providers (Google, GitHub, Discord) — for authentication

JustDMIt is not responsible for outages, policy changes, price changes, or service discontinuations by third-party providers. We will make reasonable efforts to mitigate the impact of third-party disruptions, but cannot guarantee uninterrupted availability of features that depend on external services.

If you use the Bring-Your-Own-Key (BYOK) feature to connect your own API keys, you are solely responsible for compliance with the respective provider's terms of service and usage policies.

7. Account Suspension & Termination

7.1 By JustDMIt

• Zero-tolerance violations (Section 4.1) result in immediate, permanent account termination without prior warning. Data may be preserved and shared with law enforcement.
• Other violations (Section 4.2) follow a graduated process: written warning, temporary suspension, and permanent termination. We reserve the right to skip steps where the severity of the violation warrants it.
• JustDMIt reserves the right to terminate or suspend any account at its discretion with 14 days' written notice, without cause, provided that any prepaid subscription fees are refunded pro rata.

7.2 By You

You may delete your account at any time from your account settings or by emailing gm@justdmit.com. Upon deletion:

• Your personal data will be erased within 30 days in accordance with our Privacy Policy.
• Content you shared in multiplayer campaigns may be retained in anonymised form to preserve the integrity of other users' campaign histories.
• Any active subscription will not be refunded for the remaining billing period unless required by applicable law.

8. Subscription & Payments

Certain features of the Platform may require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscription terms, pricing, and billing cycles are presented at the point of purchase and may change with 30 days' notice.

Free-tier users may be subject to usage limits (AI generation quotas, storage limits, feature restrictions). We reserve the right to modify free-tier limits with reasonable notice.

9. Limitation of Liability

The Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

• JustDMIt does not warrant that the Platform will be uninterrupted, error-free, or secure.
• JustDMIt is not liable for any loss of data, revenue, or creative work beyond the scope of reasonable backups maintained by the Platform.
• To the maximum extent permitted by Polish law, JustDMIt's total aggregate liability arising from or related to these Terms or your use of the Platform shall not exceed the greater of €50 or the total fees you have paid to JustDMIt in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless JustDMIt, its operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Platform or any content you create, upload, or distribute through it.
• Your violation of these Terms or any applicable law.
• Any third-party claim that your content infringes their intellectual property or other rights.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the Platform shall be submitted to the exclusive jurisdiction of the courts competent for the registered seat of JustDMIt in Poland. This does not affect your statutory rights as a consumer under EU law, including the right to bring proceedings in your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the Last updated date above and notify registered users by email at least 30 days before the changes take effect.

Continued use of the Platform after the effective date of updated Terms constitutes your acceptance. If you do not agree with the revised Terms, you must stop using the Platform and may request account deletion.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
